The Details of the Financial Recovery in Case of a Peasant Farm Bankruptcy

The Russian market is a historical system with agricultural specialization. One of the strategic directions of development of our country is to increase the economic potential of agriculture. One of the new phenomena of the post-reform period in Russia was the revival and development of the Institute of Agricultural entrepreneurship as a peasant (farmer's) economy (hereinafter - KFH), the legal status of which is currently not fully worked out. Improvement of the legal framework governing the activities of individual farms, began with a period of radical transformation of the Russian legislation in the early 90's of the last century.

Today we can speak of the uncertainty in the civil regulation KFH, and, therefore, that there are problems in dealing with issues such as the financial recovery of individual farms. In addition, there are some difficulties in the regulation of financial recovery KFH, the base of which is quite specific and different from the financial recovery of legal entities and individual entrepreneurs.

Legislator has not yet well established provisions on prevention and rehabilitation of bankruptcy KFH.

The main purpose of writing this article was to analyze the complex set of relationships involving financial rehabilitation of KFH in bankruptcy. In this paper the author has considered especially financial recovery procedures in case of bankruptcy of the peasant (farmer's) economy. Analyzes the norms of the bankruptcy law on financial recovery CK: bases and implications of, the characteristic financial recovery plan and repayment schedule, the grounds for termination procedures.
